In his address to a Joint Session of Congress this evening, President Obama repeated his claim that “no federal dollars will be used to fund abortion.” However, he failed to commit to supporting language that explicitly prohibits the use of taxpayer dollars for abortion.
AUL’s President and CEO, Dr. Charmaine Yoest, expressed disappointment in the President’s address, stating, “President Obama has previously articulated a desire to see a decrease in the number of abortions performed in the United States. Yet he is throwing his support behind legislation that will equate abortion with basic health care.” Dr. Yoest further explained that “Americans understand that abortion is not health care, and that the women and unborn children in our country deserve better.”
AUL’s Staff Counsel, Mary Harned, said, “No matter how President Obama and Congress change the structure of the health care reform proposals — whether there is a public option, co-op, exchange, or the like — any legislation that provides government funding for health care must contain explicit language that excludes abortion. Abortion is not health care; however, based on how courts have interpreted Medicaid, we know that courts will interpret any legislation relating to government-funded health care as requiring abortion coverage unless there is an explicit prohibition (like Hyde).”
In their legal memoranda, AUL’s legal team has carefully explained how existing law will not prevent the health care bills from mandating taxpayer funding of abortion. They also documented how seven circuit courts have held that abortion is covered under Medicaid, necessitating an explicit prohibition on the inclusion of abortion. Dr. Yoest stated that “courts will certainly interpret any legislation that provides federal funding for health care as they have interpreted Medicaid in the past. So, any health care reform must include an explicit prohibition on abortion funding and coverage.”
Current proposals mandate abortion coverage and funding in a number of ways, including:
- An amendment to H.R. 3200 permits and may require abortion coverage in the public health insurance plan, and permits taxpayer funding of private plans that cover elective abortion through the provision of affordability credits
- The Senate HELP bill delegates to a “Medical Advisory Committee” the role of deciding what benefits any private or public health care plan must offer. This Committee is expected to include abortion as a required minimum benefit.
- Prior court holdings that state that abortion is included within several of Medicaid’s mandatory categories of care (inpatient services, outpatient services, and preventative care) will certainly apply to any federal statute revising Medicaid and involving health care reform.
- The rejection of several key pro-life amendments in the House and Senate Committees, which would have ensured that abortion was not funded in the bills, demonstrates that the bills are intended to mandate abortion.

Please note that the left is changing their deceptive terminology once again. Since their euphemism of “choice” infers election and elective proceedures can not and must not be payed for by any essential care plan, they are now refering to the abominable life ending proceedures as “reproductive rights” to give these acts more of an essential flare. However, just because a person has a “right” to do something, it doesn’t necessarily mean they have an obligation to do it so there is still an elective element despite their new terminology.
I am in total agreement AUL’s response to President Obama’s address to joint sessions of congress September 9, 2009.

Why not target the Congress and Senate Commisions as you have done or will do with the Capitol Hill legislative staff and White House officials.
They decide to a large extent what is included for discussion on any bill.
DON’T TRUST THE PRESIDENT’S WORDS. HIS ACTIONS SPEAK VOLUMES OF HIS REAL THOUGHTS!!! THEY ARE NOT GOOD FOR THE USA.
We oppose any health care bill that mandates or covers abortion as a health issue. Abortion kills a living human being and should be banned as an option.
We also oppose any health care bill that promotes end of life counseling with a government official. End of life is a very personal decision to be discussed with family members, a person’s doctor, and a faith clergy, the government needs to stay away from this decision!!
Also, illegals are breaking the law, they should not be included in government health care paid by taxpayers dollars. Let them get work permits and pay taxes as every other American if they want free health care.
If any of the congressman’s ,Senators, and white house cared about saving lives, why would they fund abortion ?? If they wanted to save lives why want they stop the killing of the unborn.??

I want to thank you for all of the hard work you are doing. I must say living in WI I have been very discouraged by our representatives and their non- response to take action to keep abortion out of health care. I want so much to thank the members of congress who are pressing in and standing firm in their beliefs and positions to fight this battle. I thank them for hearing the people and giving voice for those of us who have been silenced in this fight.

I wonder if the > 50% of US Catholics who voted for obama now recognize the nature of the stranger they put in office and the distorted knowledge/understanding he has of what 70-80% of adult US CITIZENS consider is the American Dream we’ve been blessed with for 200 plus years.
In fact, a large proportion of the others who voted for him should also have realized the lack of evidence to predict his success in any office (how many times did he vote PRESENT while in the senate?) , let alone President.

Leave abortion out of our health care!
How many children have each of your members adopted. How many drug addicted, mentally challenged, deformed, mixed race children have been adopted by your list. If everyone adopted, there would not be any children in foster care…Where are you, those who do not want abortion. Do you want suicide by police instead? Or are you hoping for mentally challenged employees that don’t unionize and you can pay sweat shop wages to.

We appreciate what hard work you have put into the pro-life and healthcare . Even if medicaid weren’t there, once amnisty is given to all illegals, and it will get passed, they will all get our healthcare and abortion will be given on our tax dollar. We have got to fight to keep congress from passing public healthcare, Just fix the bad in what we already have, IT IS BETTER THAN ANY OTHER COUNTRY HAS, I’M A SENIOR CITIZEN AND I’M NOT COMPLAINING ABOUT MY HEALTHCARE.

Whether it’s reproductive rights or choice it still makes no logical and certainly no moral sense to have killing (abortion) as part of a Health CARE PLAN. Wake up you legislators and people don’t put them back in office or else we deserve what we get!!
